1. Acceptance of Terms

These Terms of Service ("Terms") govern access to and use of the websites playfrog.gg and playfrog.games, the Playfrog command line tools and APIs, and all related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. The Service

The Service enables users ("Creators") to upload browser games ("User Content") and makes that content playable by visitors. The Service is provided free of charge at this time. We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

3. Accounts

Certain features require an account, created through Google sign-in or email verification. You are responsible for activity occurring under your account and for keeping access to your sign-in email secure. Accounts are available to individuals aged 13 or older (16 where required by applicable law).

4. User Content and License

Creators retain all ownership rights in their User Content. By uploading User Content, you grant Playfrog a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content solely for the purpose of operating and promoting the Service. This license terminates when the content is deleted from the Service, except for copies retained in routine backups for a limited period.

You represent and warrant that you hold all rights necessary to upload the User Content and that it does not violate these Terms, the Content Policy, or applicable law. Publishing tokens (including manage tokens) are bearer credentials; you are responsible for keeping them confidential.

5. Prohibited Conduct

You may not upload content described as prohibited in the Content Policy; attempt to gain unauthorized access to the Service or its infrastructure; interfere with the operation of the Service, including through automated bulk publishing; misrepresent the origin of content; or use the Service to distribute malicious code.

6. Unclaimed Content

User Content published without an associated account is retained for seven (7) days. If not claimed within that period, the content and its files are permanently deleted. Claimed content is retained until deleted by the Creator or removed under these Terms.

7. Intellectual Property Complaints

We respond to notices of alleged infringement. Rights holders may submit notices via the report function on any game page or by email to abuse@playfrog.gg, including identification of the work, the allegedly infringing material, and contact information. We may remove content and terminate repeat infringers' access.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT CONTENT WILL NOT BE LOST. CREATORS ARE RESPONSIBLE FOR MAINTAINING THEIR OWN COPIES OF THEIR CONTENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PLAYFROG AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, REVENUE, OR PROFITS, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (USD 100).

10. Indemnification

You agree to indemnify and hold harmless Playfrog and its operators from claims, damages, and expenses (including reasonable legal fees) arising from your User Content or your violation of these Terms.

11. Termination

We may suspend or terminate access to the Service for violation of these Terms or the Content Policy. You may stop using the Service and delete your account at any time. Sections 4 (as to granted licenses during the license period), 8, 9, and 10 survive termination.

12. Changes to These Terms

We may revise these Terms from time to time. Material changes will be indicated by updating the date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
